1. Introduction

Welcome to Prodofoto ("Service", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our AI-powered product photography application for Shopify merchants.

By installing or using Prodofoto, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

2. Service Description

Prodofoto is a Shopify application that uses artificial intelligence to generate lifestyle product photography. Our Service allows you to:

  • Upload product images from your Shopify catalog
  • Generate AI-powered lifestyle photos featuring your products
  • Create product-only photos with enhanced backgrounds
  • Publish generated images directly to your Shopify store

3. Account and Access

To use Prodofoto, you must have an active Shopify store. Access to our Service is granted through Shopify's OAuth authentication system. You are responsible for:

  • Maintaining the security of your Shopify account
  • All activities that occur through your connected store
  • Ensuring your use complies with Shopify's Terms of Service

4. Billing and Credits

Prodofoto operates on a credit-based system. Payment processing is handled through Shopify's billing system.

  • Credits: Each image generation consumes credits from your account. The number of credits varies by plan and generation type.
  • Subscriptions: Monthly subscription plans renew automatically through Shopify billing.
  • Credit Packs: One-time credit purchases do not expire and are non-refundable.
  • Refunds: Subscription refunds are handled according to Shopify's refund policies. Generated images cannot be "refunded" for credits once generation is complete.

5. Intellectual Property

Your Content: You retain all rights to the original product images you upload. By uploading images, you grant us a limited license to process them for the purpose of generating photos.

Generated Images: You own the images generated by our Service for your products. You have full commercial rights to use, modify, and distribute these images for your business purposes.

Our Service: Prodofoto, including our technology, branding, and interface, remains our intellectual property.

6. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate images. You acknowledge that:

  • AI-generated images may not perfectly represent your products in all cases
  • Generated images may vary in style, composition, and accuracy
  • AI models depicted in lifestyle photos are computer-generated and not real individuals
  • You are responsible for reviewing generated images before publishing to your store
  • We do not guarantee specific results or outcomes from AI generation

7. Acceptable Use

You agree not to use our Service to:

  • Generate images of illegal products or services
  • Create deceptive or misleading product representations
  • Produce inappropriate, offensive, or harmful content
  • Violate any applicable laws or regulations
  • Infringe on third-party intellectual property rights
  • Attempt to reverse-engineer our AI technology
  • Abuse or exploit the Service in any manner

We reserve the right to suspend or terminate accounts that violate these terms.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODOFOTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Termination

You may stop using our Service and uninstall the app from your Shopify store at any time. Upon termination:

  • Your subscription will be cancelled at the end of the current billing period
  • Unused credits from subscription plans will expire
  • Previously generated images that have been saved to your store remain yours
  • We may retain certain data as required by law or for legitimate business purposes

We reserve the right to suspend or terminate your access for violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
